Exposing NSA Fraud in a Qui TamLawsuit Under the False Claims Act

A significant portion of our practice involves representing clients in whistleblower litigation under the False Claims Act. Similar to state whistleblower laws, the federal False Claims Act allows private citizens to expose fraud to the government. However, unlike many state laws, the False Claims Act includes whistleblower reward provisions, and rewards under the False Claims Act have the potential to be substantial.

When whistleblowers disclose information potentially leading to the recovery of taxpayer funds, they are entitled to strict confidentiality and anti-retaliation protections. When the federal government successfully recovers taxpayer funds (i.e., from NSA contractors), eligible whistleblowers are entitled to a percentage of the funds recovered. In most cases, whistleblower rewards under the False Claims Act will range from 15% to 30% of the government’s recovery.

How do I blow the whistle on fraud involving an NSA contract?

 

In most cases, blowing the whistle on fraud involving an NSA contract will involve filing a qui tam lawsuit under the False Claims Act. The False Claims Act protects eligible whistleblowers, and it also includes provisions for monetary rewards when whistleblowers help the government pursue successful enforcement actions against NSA contractors and other entities.

Under the FISA amendments, eligible employees of NSA contractors are entitled to whistleblower protections if they come forward through other means as well. How do I blow the whistle on misconduct within the NSA?

What qualifies as a “protected disclosure” for purposes of serving as an NSA whistleblower?

 

Presidential Policy Directive 19 (PPD-19), titled Protecting Whistleblowers with Access to Classified Information, defines what qualifies as a “protected disclosure” for purposes of blowing the whistle on an NSA employee or NSA contractor. Under Section F(5)(a) of PPD-19, protected disclosures include (but are not limited to):

“[A] disclosure of information . . . that the employee reasonably believes evidences (i) a violation of any law, rule, or regulation; or (ii) gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.”

Additionally, to qualify as a protected disclosure, a whistleblower complaint must be submitted to either: (i) a supervisor in the employee’s direct chain of command; (ii) an Inspector General, (iii) the U.S. Director of National Intelligence, or (iv) another designated federal employee or office. Whistleblowers must also ensure that their complaints do not “result in . . . disclosing classified information or other information contrary to law,” as such disclosures are not protected under PPD-19.

Does the NSA have a whistleblower program?

 

The NSA Inspector General maintains a hotline that whistleblowers can use to make protected communications (though not necessarily “protected disclosures”) to the Agency. However, whether whistleblowers should come forward by using the Inspector General’s hotline or through other means depends on the specific circumstances at hand. As a result, we strongly recommend that you speak with an NSA whistleblower attorney before attempting to come forward under the NSA’s whistleblower program as well.
